Sarah completed the manufacture’s training to operate the Alco-Sensor FST, the newest breathalyzer used by BC police to issue IRPs.

CHALLENGING IRP DRIVING PROHIBITIONS

Sarah developed unique arguments on IRP 90-day driving prohibition cases, including challenging what evidence must be adduced to prove that the device used is in fact an Approved Screening Device. The obligations on the police to provide certain evidence has been greatly influenced by arguments Sarah has advanced in IRP cases. She has extensive knowledge of proper police procedure in DUI investigations and she can identify police mistakes when defending IRP cases for her clients. Sarah is a dedicated IRP lawyer. She has been successful in a vast number of IRP DUI cases where individuals have provided a breath sample that result in a ‘WARN’ or ‘FAIL’ reading and in circumstances where individuals have failed or refused to provide breath samples.
Sarah is currently handling numerous IRP appeals in the BC Supreme Court. She has secured the return of drivers licenses for hundred of clients in B.C. She has also been successful in having driving prohibitions revoked on supplementary reconsideration by the Ministry of Justice and returned for a new review. Sarah advanced the first of many Petitions in BC Supreme Court that ultimately caused 1,200 Immediate Roadside Prohibition cases to be reconsidered by the Office of the Superintendent of Motor Vehicles/RoadSafetyBC.

Sarah Leamon was born and raised in Fort McMurray, Alberta. She earned two Bachelor of Arts degrees from the University of Calgary and a Masters Degree from UBC. Sarah earned her Juris Doctor from Bond University in Queensland, Australia. Her academic career focused on criminal law, miscarriages of justice and the application of the Charter of Rights. Her current areas of practice are mainly in the areas of criminal defense, administrative law and driving law.
