Victoria lawyer Sacha Roudette built her reputation on Vancouver Island as a top local authority on legal challenges to the Immediate Roadside Prohibition law. In Victoria she has been the first lawyer many clients call to defend an IRP. She has helped thousands of Vancouver Island drivers get their driver’s license back after receiving a 90-day driving prohibition. She has conducted countless IRP appeal hearings before the Superintendent of Motor Vehicles and has argued a number of high profile cases in BC Supreme Court and Court of Appeal.

In addition to defending 90-day IRPs at the tribunal level, Sacha acted on the successful constitutional challenge of the original IRP legislation before the BC Supreme Court. She collaborated on the successful defeat of the government’s appeal of the Sivia decision in the B.C. Court of Appeal. Shorty after having secured the court order to strike down the original IRP legislation, Sacha also appeared in BC Supreme Court to argue on behalf of her clients for constitutional and personal damages. Sacha has also argued numerous cases in BC in Supreme Court and Court of Appeal to obtain court orders for the return of her client’s BCDL in hardship scenarios. Sacha appeared in the Supreme Court of Canada in a further collaborative and complicated appeal regarding the constitutionality of the IRP legislation.

Sacha also successfully challenged the BC government and the Superintendent of Motor Vehicles’ authority to continue to rely on IRP legislation after the law had been ruled unconstitutional. The Supreme Court quashed her clients’ driving prohibitions, monetary penalties, vehicle impoundments and remedial program referral. She is one of the very few lawyers in British Columbia to have successfully argued for an award of costs against the Superintendent in an IRP case.

Sacha Roudette graduated from the University of Victoria in 2011 with her Juris Doctor and was called to the British Columbia Bar in 2012. While she was in law school, Sacha was selected for a prestigious nation-wide award by the B.C. Civil Liberties Association for her paper in critique of the B.C. Supreme Court’s decision to refuse to hear the Sex Workers United Against Violence’s challenge to the constitutionality of Canada’s prostitution laws. Before Sacha settled in Victoria, she lived in several Canadian provinces and in Europe. She learned to speak a number of languages. She is a straightforward and fair problem-solver dedicated to protecting the legal rights of her clients.

Sacha is also is a member of the Trial Lawyers Association of B.C., the Canadian Bar Association, and the Victoria Bar Association. She has completed the manufacturer’s training to operate the police roadside breathalyzer used in IRP cases. She confers with colleagues in British Columbia and the United States regarding DUI defence.
